Please carefully review these Terms of Service (“Terms”) before using the altindesign.com website (the “Website”) operated by Altin Design, a WordPress Design and Development agency in Bangkok, Thailand (“us,” “we,” “our”). These Terms of Service contain essential information regarding the limitations of our liability. Your access to and use of this Website is subject to your acceptance of and adherence to these Terms. These Terms apply to all individuals, including but not limited to visitors, users, and others, who desire to access and utilize the Website.

By accessing or using the Website, you acknowledge and agree to be bound by these Terms. If you disagree with any part of these Terms, we regretfully cannot grant you permission to access or use the Website.

Service Agreement

By choosing Altin Design for any services listed on our website, you initiate a service agreement with us. The specific terms, scope of work, and pricing details will be provided in a comprehensive quote or separate agreement, tailored to meet your specific requirements.

Intellectual Property

Altin Design retains all rights, title, and interest in any intellectual property developed or provided during the course of our services. This includes, but is not limited to, website designs, code, graphics, and other materials. You may not use, reproduce, or distribute our intellectual property without our explicit permission.

Confidentiality

Any information shared with us during the course of our services will be treated as confidential and will not be disclosed to third parties unless required by law. We respect the privacy of our clients and maintain the confidentiality of sensitive information.

Payment

Payment terms will be outlined in the service agreement. We may require a deposit before commencing work, and the full payment will be due upon project completion unless otherwise stated in the agreement.

For each charge, invoices will be generated, and the Client will make payments through bank transfer or credit card. Altin Design retains the right to suspend all services in the event of past due balances remaining unpaid for 8 weeks or longer. Additionally, late-payment charges of 2% per month may be applied to those outstanding balances.

Disclaimer of Liability

Altin Design provides services with the utmost professionalism and expertise. However, we do not guarantee the success, performance, or outcomes of your website or business. We are not liable for any damages, losses, or expenses arising from the use or inability to use our services.

Third-Party Services

We may use third-party services, plugins, or tools to enhance our offerings. While we strive to work with reputable providers, we are not responsible for any issues, damages, or losses resulting from these third-party services.

Termination

This Agreement between Altin Design and the Client shall remain valid unless either party terminates it in writing, except for cases of non-performance by either party. Altin Design will initiate Client’s subscription billing in accordance with the payment terms provided below, and any recurring billing will automatically renew for subsequent one (1) month periods.

To terminate this Agreement and subsequent billing, the Client must send a formal written or email notice to Altin Design at least thirty (30) days before the desired termination date. Failure by the Client to make timely payments according to the billing due dates grants Altin Design the option to immediately terminate this Agreement.

Upon termination or expiration of this Agreement due to non-payment or non-performance by the Client, (i) all licenses granted by Altin Design to the Client will cease automatically, requiring the Client to immediately discontinue the use of the licensed content and any marketing collateral provided by Altin Design, and (ii) the Client’s entitlement to any and all services provided by Altin Design will be automatically terminated.

In the event that the website subscription has not been fully paid at the time of its termination, Altin Design will retain an archived copy of all content, including copywriting, graphic design, and WordPress code, for a duration of one (1) year. Following this one (1) year period, all content associated with the canceled website subscription will be permanently removed.

Modification to Services and Pricing

Altin Design retains the right to make adjustments to our services, either temporarily or permanently, at any time, and such modifications will be communicated through updates posted on our website. We may introduce improvements to certain services or decide to discontinue accepting new signups for specific services.

Occasionally, we may revise the pricing of our services. Generally, existing customers will be exempt from these changes; however, there might be certain circumstances in which pricing adjustments could apply to existing customers. In such instances, we will notify you through the email address on record, providing at least 30 days’ notice before implementing the changes.

Commitment to Mutual Respect

At Altin Design, we firmly believe in fostering an environment of mutual respect between our team members and our esteemed clients, including you/your organization. We expect the same level of respect and professionalism in return. A foundation of respect, politeness, and professionalism is essential for all interactions and communications.

If, at any point, either party identifies a lack of respect or professionalism, it may result in the termination of the project and support for your websites.

Examples of behavior that may lead to termination include, but are not limited to:

  • Using threatening or abusive language, profanity, or any language that may be perceived as demeaning, berating, rude, threatening, intimidating, hostile, or offensive.
  • Employing epithets, slurs, or engaging in negative stereotyping.
  • Making threats of violence, retribution, litigation, or financial harm, as well as engaging in any speech, conduct, or mannerisms that others may reasonably perceive as intimidation or harassment.
  • Making comments or engaging in behavior that is untruthful or constitutes a personal attack on the professional conduct of others.

Changes to Terms

We reserve the right to update or modify these Terms of Service at any time without prior notice. Continued use of our website and services after any changes will constitute acceptance of the revised terms.
